Agreement to these terms
These Terms and Conditions ("Terms") are a binding agreement between you and Better Coverages LLC ("Better Coverages," "we," "us"). They govern your use of our websites, landing pages, forms, and communications (the "Sites"), our consumer matching service, and the lead delivery, filtering, reporting, API, and managed media services we provide to businesses (together, the "Services").
By using the Sites or Services, submitting a form, or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
If your business has signed an insertion order, master services agreement, or other written agreement with us (an "Order"), the Order controls where it conflicts with these Terms.
What we are, and what we are not
Better Coverages is a performance marketing company. We create advertising, operate the forms and funnels it leads to, verify submissions, and deliver requests to licensed insurance agents, agencies, marketing organizations, and carriers ("Network Partners").
- We are not an insurance company, and we do not underwrite, issue, or sell insurance policies.
- We do not give insurance, legal, tax, or financial advice. Any quote, recommendation, or policy comes from a Network Partner or insurer, and its terms are between you and them.
- We do not guarantee that you will be contacted, receive a quote, qualify for coverage, or get any particular rate.
- We do not endorse any Network Partner, and we are not responsible for their products, advice, or conduct.
Medicare
Better Coverages is not connected with or endorsed by the U.S. government or the federal Medicare program. Where required by the Centers for Medicare & Medicaid Services (CMS), the following disclaimer applies:
Who can use the Services
You must be at least 18 and a resident of the United States to use the Services. You agree that the information you give us is true, accurate, current, and your own, and that any phone number you provide is yours or one you are authorized to consent for. Submitting someone else's information, or false information, is prohibited.
If you use the Services on behalf of a business, you confirm that you have authority to bind it to these Terms, and "you" includes that business.
Matching services for consumers
Our consumer service is free. When you submit a request, we may verify it and share it with one or more Network Partners who may be able to help with the coverage you asked about, and they pay us for it. Which partners receive your request can depend on your location, the coverage you want, partner availability, and the consent you gave.
Network Partners are independent businesses. Any conversation, quote, application, or purchase is between you and them. Before you buy, review the policy terms carefully and confirm the licensing of anyone advising you.
You can stop at any point. You are never obligated to speak with a partner, request a quote, or buy anything.
Consent to calls, texts, and emails
When you check the consent box and submit a form, you give prior express written consent for Better Coverages and the Network Partners identified in the disclosure on that form to contact you at the number and email you provide, about the insurance products you asked about, including by:
- Calls and text messages sent using an automatic telephone dialing system or other automated technology.
- Artificial or prerecorded voice messages, including AI-generated voices.
- Email.
This consent applies even if your number is on a federal, state, or internal Do Not Call list. Consent is not a condition of purchase. You can call us at [1-800-000-0000] instead.
You can revoke consent at any time by any reasonable means, including replying STOP to a text, telling a caller, or contacting us using the details below. Message frequency varies. Message and data rates may apply. Reply HELP for help. Carriers are not liable for delayed or undelivered messages.
Please tell us promptly if you give up or change a phone number you gave us. Calls may be recorded and monitored for quality, training, and compliance, where permitted by law and disclosed on the call.
Services and platform for business customers
We offer business customers per-lead delivery, live call transfers, and managed media programs, together with an online platform, APIs, and integrations for configuring filters, caps, schedules, and delivery, and for reporting (the "Platform"). Volumes, pricing, filters, exclusivity, and service levels are set in your Order or in the Platform.
Accounts
- Keep credentials and API keys confidential, limit access to people who need it, and tell us promptly about any unauthorized use. You are responsible for activity under your account.
- Give us accurate business, licensing, and billing information, and keep it current.
Platform use
We grant you a limited, non-exclusive, non-transferable right to use the Platform during your term for your internal business purposes. You may not copy, resell, or sublicense the Platform; reverse engineer it except as the law permits; interfere with its security or performance; exceed published rate limits; or use it to build a competing service.
We may update the Platform, add or remove features, and perform maintenance. Unless an Order says otherwise, the Platform is provided without a service-level commitment. Beta features are provided as they are and may change or be withdrawn.
Customer Data
You own the data you upload or send us, such as suppression lists, delivered-lead history, and CRM mappings ("Customer Data"). You grant us the right to use Customer Data to provide and support the Services, including duplicate scrubbing and routing. We may use Platform usage data, and aggregated or de-identified data that does not identify you or any consumer, to operate and improve our services.
Confidentiality
Each party will protect the other's non-public business information, including pricing, volumes, and performance data, with reasonable care, and use it only for the purposes of our relationship.
Leads, delivery, and returns
- Exclusive and shared. Exclusive leads are sold to one buyer and never re-offered. Shared leads are sold to no more than the number of buyers stated in your Order.
- Delivery. We deliver by ping-post, REST API, direct CRM integration, or live transfer, as configured. You are responsible for your systems accepting delivery. A lead is delivered when we send it to your configured destination.
- Filters and caps. You control filters, caps, and schedules in the Platform or through us. Changes take effect once saved or confirmed, and you pay for leads delivered under the settings in effect at the time of delivery.
- Consent records. Each lead includes, or we will provide on request, its consent record, such as a TrustedForm certificate or Jornaya LeadiD token, for the retention period in our Privacy Policy.
- Returns. You may return a lead within [7] days of delivery if it has a disconnected or invalid phone number, reaches the wrong person, duplicates a lead you received within the agreed scrub window, or falls outside the filters in effect when it was delivered. Submit returns through the Platform with the reason. Approved returns are credited to your account, not refunded in cash, unless your Order says otherwise. Excessive or unsupported return requests may be declined.
- Live transfers. A transfer is billable once the call passes the buffer time in your Order. Calls that end before the buffer are not billed.
- No outcome guarantee. Volume depends on media availability and consumer demand. Estimates are good-faith forecasts, not commitments, and we do not guarantee contact, quote, or sale rates.
Fees, billing, and credits
- You agree to pay the fees in your Order or Platform pricing. Unless stated otherwise, fees are in U.S. dollars and exclude taxes, which you are responsible for.
- Prepaid balances are drawn down as leads and transfers are delivered. Invoices are due within [15] days of the invoice date.
- Late amounts may accrue interest at [1.5%] per month or the highest rate the law allows, whichever is lower, and we may pause delivery until your account is current.
- Dispute an invoice in good faith and in writing within [30] days, or it is treated as accepted. Pay any undisputed amount on time.
- Credits have no cash value, are not transferable, and expire [12 months] after issue unless your Order says otherwise.
Your compliance obligations
You are responsible for your own contact with consumers. You agree that you, your staff, and anyone acting for you will:
- Hold and maintain every license required to market and sell the products you offer in each consumer's state, and give us accurate licensing information.
- Contact consumers only about the products their consent covers, only through the channels it covers, and only under your own name or the name shown in the consent disclosure.
- Comply with all applicable laws, including the Telephone Consumer Protection Act, the Telemarketing Sales Rule, the CAN-SPAM Act, state telemarketing and "mini-TCPA" laws, state privacy and insurance laws, calling-hour and call-frequency limits, and, for Medicare, CMS marketing and communications requirements.
- Scrub against Do Not Call lists where required, keep an internal Do Not Call list, honor opt-outs promptly, and send us the opt-outs you receive so we can suppress them across our network.
- Not sell, rent, transfer, or share leads with anyone else without our written permission, and use them only to offer the products the consumer asked about.
- Protect lead data with reasonable security, and tell us without undue delay about any security incident affecting it.
- Cooperate with us on consumer complaints, regulator inquiries, and consumer privacy requests relating to leads we delivered.
We may audit compliance, request call recordings and records, and suspend delivery immediately if we reasonably believe you are in breach or a complaint needs investigating. Our consent practices, and anything we say about compliance, are not legal advice. Rely on your own counsel.
Acceptable use
You may not:
- Make false, fraudulent, or automated submissions, or submit anyone else's information without authority.
- Scrape, crawl, or harvest data from the Sites or Platform, or use bots other than through our documented APIs.
- Probe or test for vulnerabilities, bypass security or rate limits, or introduce malware.
- Use the Services to break any law or infringe anyone's rights, or to send spam.
- Copy, frame, or imitate our Sites, ads, or brand, or suggest an affiliation with us that does not exist.
Intellectual property
The Sites, Platform, creative, landing pages, software, content, trademarks, and logos belong to Better Coverages or its licensors and are protected by law. Apart from the limited rights in these Terms, no rights are granted to you. If you send us feedback or suggestions, we may use them without obligation to you.
For managed media programs, ownership of creative and funnels made under your brand is set by your Order.
Third-party services and links
The Services may link to or rely on third-party sites and services, such as advertising platforms, consent-verification providers, and Network Partner sites. We do not control them and are not responsible for their content, policies, or practices. Your use of them is governed by their terms.
Disclaimers
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
Limitation of liability
Our total liability for all claims relating to the Services is limited to the greater of $100 or, for business customers, the fees you paid us in the 12 months before the claim arose. These limits do not apply where the law does not allow them, and your Order may set different limits.
We are not liable for the acts or omissions of Network Partners, advertising platforms, or other third parties.
Indemnification
You will defend, indemnify, and hold harmless Better Coverages and its officers, employees, and agents from claims, losses, fines, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your violation of law or anyone's rights, or information you submit. For business customers, this also covers your contact with consumers, including claims under telemarketing, privacy, and insurance laws, except to the extent caused by our breach.
Dispute resolution and arbitration
Informal resolution first. Before filing a claim, you agree to email [legal@better-coverages.com] describing the dispute and the relief you want, and to try in good faith to resolve it with us for 30 days. We will do the same.
Binding individual arbitration. Any dispute arising from or relating to the Services or these Terms that is not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer or Commercial Arbitration Rules, as applicable. The Federal Arbitration Act governs this section. The arbitrator decides all issues, including the scope and enforceability of this agreement to arbitrate. Either party may instead bring an individual claim in small claims court, or seek injunctive relief in court for misuse of intellectual property.
Class action and jury waiver. You and we each waive the right to a jury trial and to take part in a class, collective, or representative action. Claims may be brought only on an individual basis. If this waiver is found unenforceable for a claim, that claim will proceed in court, not in arbitration.
Opting out. You may opt out of this arbitration agreement by emailing [legal@better-coverages.com] within 30 days of first accepting these Terms, with your name, phone number, and a clear statement that you opt out. Opting out does not affect the rest of these Terms.
Suspension and termination
We may suspend or end your access to the Services if you breach these Terms, create risk or possible legal exposure for us or others, or where the law requires. Business customers may end their use as their Order allows or, without an Order, on written notice. Fees for leads delivered before termination remain payable. Sections that by their nature should survive, including fees, compliance obligations, disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination.
General terms
- Governing law. These Terms are governed by the laws of the State of [Delaware], without regard to conflict-of-law rules. Subject to the arbitration section, the courts in [New Castle County, Delaware] have exclusive jurisdiction.
- Changes. We may update these Terms by posting a new version and updating the "Last updated" date. Changes apply going forward, and continuing to use the Services after they take effect means you accept them. We will give business customers advance notice of material changes by email or through the Platform.
- Entire agreement. These Terms, the Privacy Policy, and any Order are the entire agreement between us about the Services.
- Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition, or sale of assets.
- Severability and waiver. If any provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver of it.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control, except for payment obligations.
- Notices. We may send notices by email, text, or through the Platform. Send notices to us using the details below.
